By accessing or using the website, you agree to be bound by these Terms & Conditions. If you disagree with any part of the terms, then you may not access the website.

2. Products and Services

  • Product Descriptions: We strive to ensure that all descriptions, photographs, and prices of products appearing on our website are accurate. However, minor variations may occur due to screen settings, natural material variations (e.g., wood grain), or the handcrafted nature of some items. All sizes, weights, and measurements are approximate.

  • Pricing: All prices are stated in Pounds Sterling (£) and are subject to change without prior notice. Prices shown are exclusive of VAT unless otherwise stated. VAT will be added at the current UK standard rate where applicable (if ATZ-Motion Ltd is VAT registered).

  • Availability: All products are subject to availability. While we endeavour to keep our stock levels accurate, in the event that an item you have ordered is unavailable, we will notify you as soon as possible and offer an alternative or a full refund.

  • Custom / Personalised Items: For custom-made or personalised items, please ensure all details provided are correct. We cannot accept returns or provide refunds for custom items unless they are faulty or not as described (see Section 7, Refund Policy).

3. Order Acceptance

  • When you place an order on our website, you will receive an email acknowledging receipt of your order. This email is an acknowledgment only and does not constitute acceptance of your order.

  • Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. We will confirm such acceptance to you by sending you an email confirming that the product has been dispatched ("Dispatch Confirmation").

  • The contract between us will only be formed when we send you the Dispatch Confirmation.

  • We reserve the right to refuse or cancel any order for any reason at any time.

4. Payment

  • We accept payments via major credit/debit cards and PayPal.

  • Payment is taken at the time of order placement.

  • All payment transactions are processed through secure third-party payment gateways. We do not store your full payment card details on our servers.

5. Shipping & Delivery

  • Our Shipping Policy, which forms part of these Terms, details our shipping methods, costs, delivery times, and international shipping information. Please refer to our separate Shipping Policy for full details.

  • We aim to dispatch orders within the timeframe specified on the product page or in our Shipping Policy. However, dispatch and delivery times are estimates only and are not guaranteed.

  • Risk of loss and damage to products passes to you upon delivery.

6. Intellectual Property

  • The content on the Creative Jo website, including but not limited to designs, text, graphics, logos, images, and software, is the property of ATZ-Motion Ltd and is protected by copyright, trademark, and other intellectual property laws.

  • You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content from our website without our express prior written permission.

  • All Creative Jo Ply product designs are copyrighted by ATZ-Motion Ltd. Unauthorised reproduction or distribution of our designs is strictly prohibited.

7. Refund & Returns Policy

  • Our Refund Policy, which forms part of these Terms, outlines your rights regarding returns, refunds, and exchanges, including your rights under the Consumer Rights Act 2015. Please refer to our separate Refund Policy for full details.

  • Please note: Unless faulty or not as described, custom-made or personalised items are generally not eligible for return or refund.

8. User Conduct

  • You agree not to use the website for any unlawful purpose or in any way that might harm, disrupt, or impair the site.

  • You must not attempt to gain unauthorised access to any part of the website, other accounts, computer systems, or networks connected to the website.

9. Links to Other Websites

  • Our website may contain links to third-party websites or services that are not owned or controlled by ATZ-Motion Ltd.

  • ATZ-Motion Ltd has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

10. Disclaimer of Warranties

  • The Creative Jo Ply website and all products and services delivered to you through the website are provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • We do not warrant that the website will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

  • To the maximum extent permitted by applicable law, in no event shall ATZ-Motion Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to, a visit to our website or the purchase of our products.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Changes to These Terms & Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website after those revisions become effective, you agree to be bound by the revised terms.
